Three years of waiting after obtaining U Visa status

Once a person has an approved U Visa and holds that status, they must wait three years before applying for permanent residency. The U Visa grants status that lasts four years, and it is precisely upon reaching the third year within that period that a person can file an application for adjustment of status to request residency.

What needs to be proven in order to apply for residency

Simply reaching the three year mark on the calendar is not enough. The law requires the person to demonstrate two fundamental things during that time.

First, the person must show continuous physical presence in the United States throughout those three years. This means gathering documents and evidence confirming that the person did not leave the country during that period and maintained their presence here consistently.

Second, the person must show cooperation with law enforcement, in cases where such cooperation was requested. The U Visa exists specifically to protect victims of certain crimes who assist with an investigation or a judicial process, so maintaining that cooperation when it is required remains relevant at the time of applying for residency.
