TN Visas in Fort Myers
Bilingual TN Visa Guidance Grounded in Firsthand Immigration Experience
A TN case requires more than a job offer. Canadian or Mexican citizenship, the proposed role, the applicable United States-Mexico-Canada Agreement profession, the applicant’s credentials, and the employer’s documentation must align before the professional applies.
We provide immigration representation in English and Spanish for professionals seeking to work in the United States. We assist prospective clients in Fort Myers, Cape Coral, Lehigh Acres, and beyond with determining whether this temporary employment classification fits their circumstances.

Who Qualifies for TN Status?
TN status is available to eligible Canadian and Mexican citizens working in qualifying professional occupations under the United States-Mexico-Canada Agreement, commonly called the USMCA. The category was formerly associated with the North American Free Trade Agreement, or NAFTA. Permanent residents of Canada or Mexico aren’t eligible based solely on their residency.
A potential applicant generally needs to establish:
- Qualifying citizenship: The applicant is a citizen of Canada or Mexico.
- Listed profession: The occupation appears on the USMCA professional list, and the offered position requires that type of work.
- Prearranged employment: A U.S. employer has offered a qualifying position. TN classification doesn’t permit self-employment.
- Required qualifications: The applicant holds the degree, license, alternative credential, or experience required for the occupation.
- Temporary purpose: The proposed employment is temporary and consistent with nonimmigrant intent. The applicant can’t use TN status to remain in the United States permanently.
Many listed occupations require a bachelor’s degree, but the standards vary by profession. Some permit alternative credentials or require additional experience, making a category-specific review important.
Different Application Routes for Canadian & Mexican Citizens
The appropriate route depends on the applicant’s citizenship, current location, immigration status, and type of request. Canadian and Mexican professionals don’t follow the same initial application process.
Common TN application routes include:
- Canadian citizens: Eligible applicants may generally request TN admission at a designated U.S. port of entry without first obtaining a visa. Their supporting documents are reviewed during that process.
- Mexican citizens: Applicants generally must obtain a TN visa through a U.S. embassy or consulate before requesting admission at a port of entry.
- Applicants inside the United States: A prospective employer may file a petition with United States Citizenship and Immigration Services for a qualifying change or extension of status, depending on the worker’s circumstances.
We evaluate the proposed route and supporting materials as part of an individualized case assessment. Attorney Hurtado’s prior service as an Assistant State Attorney informs our disciplined document review, while secure digital tools allow us to communicate with clients throughout the United States and abroad.
How Employer Documents Support a TN Application
The employer support letter is central to the application. It should identify the employer, describe the professional activities, state the anticipated employment period and compensation arrangements, and connect the actual duties to a specific USMCA occupation.
Supporting materials commonly include:
- Proof of Canadian or Mexican citizenship.
- A detailed offer or support letter from the U.S. employer.
- Information about the position’s duties, location, duration, and compensation.
- Diplomas, transcripts, licenses, evaluations, or evidence of experience required for the occupation.
- Documents relevant to the selected border, consular, or agency filing route.
A similar job title isn’t enough when the daily duties don’t fit the listed profession. Licensing may also require separate attention because immigration eligibility and permission to practice a regulated profession can be decided by different authorities.
TN Extensions, Employer Changes, & Dependents
TN status may be granted for up to three years at a time, subject to the application route and continued eligibility. An extension, a new employer, or a material change in employment may require another filing or admission process.
Spouses and unmarried children under 21 may seek TD dependent status. Qualifying family members can accompany the TN professional, but TD status doesn’t independently authorize a spouse to work in the United States.
Prior refusals and long-term immigration plans also warrant careful review. TN is a temporary nonimmigrant classification, not a direct path to permanent residence. Future green card goals require a separate analysis of timing, intent, and available categories.
